SALE AGREEMENT

ARTICLE 1 SUBJECT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the products/services, with the characteristics specified below, for the reservation transactions made by the BUYER through electronic means on the website of the SELLER OR PROVIDER or through the call center.

The BUYER accepts and declares that he/she has been provided clear, understandable, and suitable pre-information in the internet environment regarding the name, title, address, phone number, and other contact information of the SELLER OR PROVIDER, the basic characteristics of the product subject to sale, the sales price including taxes, the payment method, etc., along with all pre-information regarding the product/service subject to sale, the exercise of the right of withdrawal, how this right can be exercised, official authorities where he/she can submit complaints and objections, etc.; that he/she has confirmed this pre-information electronically and/or via phone or email and subsequently approved the reservation and the agreement in accordance with the provisions of this agreement.

SELLER OR PROVIDER INFORMATION Title: Turperest Tourism and Transportation Limited Company (hereinafter referred to as TURPEREST in this agreement). The address and official communication details are clearly stated in the header section.

ARTICLE 2 GENERAL PROVISIONS

2.1 The BUYER states that he/she has read and is knowledgeable about the characteristics of the product, the service, the sales price, the payment method, and all pre-information regarding the price and has given the necessary confirmation in the electronic environment and the call center system. The total amount of the reservation fee is paid at the time of registration. If the total amount is not paid, no reservation is made. However, if a reservation is made despite having a balance deficiency for any reason, the Consumer is responsible for the entire reservation fee from the registration date. In the event of insufficient payment of the reservation fee, TURPEREST may cancel the reservation and request all damages incurred due to the cancellation from the Consumer. The Consumer has made the purchase knowing this situation.

2.2 The SELLER OR PROVIDER is responsible for any defect in the service subject to the agreement.

2.3 In the event that the service subject to the agreement is used by a person other than the BUYER, the SELLER OR PROVIDER is not responsible for that person's refusal to perform.

2.4 For the execution of the service subject to the agreement, a signed copy of this agreement must have been delivered to the SELLER OR PROVIDER and the fee must be paid in the preferred payment method. If the SELLER or PROVIDER has sent the agreement to the BUYER in accordance with the relevant regulation and this agreement, the BUYER cannot claim that the agreement does not bind him/her because he/she has not signed and returned it; all responsibility rests with him/her, and he/she is obliged to pay the contract price in full. It is sufficient for the SELLER/PROVIDER to have sent the agreement to the email address provided by the BUYER, and the BUYER cannot claim that the agreement was not sent to him/her or that he/she did not read it.

2.5 If the BUYER's credit card is used unlawfully or unlawfully by unauthorized persons after the service is performed, and the relevant bank or financial institution does not pay the service fee to the SELLER OR PROVIDER, the BUYER is responsible for the damages incurred.

 ARTICLE 3 SERVICES THAT CANNOT USE WITHDRAWAL RIGHT

TURPEREST is an intermediary between the service provider and the BUYER. Due to the nature of the services sold by the tour operator within the framework of this agreement, the BUYER does not have the right of withdrawal in distance sales as per the Regulation. The entire fee is collected from the BUYER. The BUYER has accepted this by purchasing the service. Early reservations, special periods (New Year's, semester, holidays, etc.), and accommodation transactions purchased during promotional periods cannot be canceled. However, if the BUYER has purchased an Early Reservation Cancellation Guarantee Package regarding domestic and Cyprus accommodation during the Early Reservation period and Summer Opportunities, processing can be done under the conditions specified in Article 10. The BUYER has purchased the service with this knowledge and acceptance. Reservations made with the phrase "cannot be canceled" cannot have the Early Reservation Cancellation Guarantee Package offered. In reservations with this statement, cancellation, changes, and refunds are not permitted. If transportation (flight, bus, transfer, etc.) is purchased in addition to the accommodation, there are no refunds for transportation fees.

ARTICLE 4 INFORMATION

According to Article 6 of the Regulation, the BUYER is obliged to check and digitally approve the information form containing the date, price, product, concept, etc. regarding the service chosen during the purchase phase of the reservations made through the relevant website and Call Center. The SELLER is not responsible for the absence of the necessary checks and for not providing digital approval. Records of approvals are kept in the electronic environment.

ARTICLE 5 CANCELLATION- WITHDRAWAL- CHANGES

The SELLER OR PROVIDER may cancel the agreement if there are force majeure situations or situations arising from service providers, hotels to be stayed at, or third parties that obstruct the commencement or continuation of the service, despite having exercised all due care. In this case, the SELLER OR PROVIDER is obliged to notify the BUYER as soon as possible. The BUYER shall have no right to compensation in such cases. In such cases, the SELLER OR PROVIDER is obliged to refund the amount received from the person or organization from which he/she purchased the service or acted as an intermediary. He/She cannot be held liable for the refund of the amount that has not been received.

5-1- The BUYER is obliged to submit any cancellation, change, and addition or removal of persons related to the reservation in writing.

5-2- The travel agency may cancel the trip 3 days before the departure date due to insufficient number of confirmed registrations or force majeure situations; the consumer has no right to compensation in this case.

5-3- If the consumer requests to cancel or change the trip more than 30 days before the trip starts, the full fee will be refunded in accordance with the package tour regulation.

5-4 The consumer agrees and undertakes to pay 10% of the trip fee if he/she requests to cancel or change the trip 30 to 16 days before the start of the trip, 35% of the trip fee if he/she requests to cancel or change 15 to 7 days before, and the full amount less than 7 days before. In reservations made within 7 nights of the start of the service, there is no right to cancellation, refund, or change.

5-5 If the consumer wishes to cancel the discounted product purchased during a discounted sales period for any reason without purchasing a cancellation guarantee package, he/she agrees and undertakes to pay the full trip fee to TURPEREST.

5-6 If the consumer wants to make any changes to the date of the discounted early reservation product purchased during a discounted sales period for any reason, it will be accepted that the reservation change will be made at the list prices valid at the time of the request without the discount.

5-7 If the consumer fails to notify the travel agency in writing that he/she will join the trip late, the travel agency has the right to cancel all reservations made on behalf of the consumer 24 hours later. No refund will be provided in such cancellations, and the remaining payment must be made by the consumer to the agency.

5-8 Force majeure: Adverse weather conditions, roadblocks, strikes, terrorism, war, war threats, unforeseeable technical issues hindering the commencement or continuation of the trip shall be accepted as force majeure by the parties. The illness or death of the consumer or their first-degree relatives that impedes their normal activities for 10 days, evidenced by official documents from state authorities is also considered force majeure.

5-9 The travel agency may cancel the tours it has announced or registered for as it sees necessary until 3 days before the start of the trip, either partially or completely. Within the same period, it may change the names of the hotels included in the trip, the means of transportation and their departure locations, and the order of visits to places indicated in the program. If the consumer does not accept these changes or cancellations, he/she has the right to cancel the reservation and receive the full amount paid.

5-10 The travel agency may operate jointly with partner agencies if it does not reach the required number of participants for the trip you will join. The consumer will receive the main services of hotel accommodation, transportation, and guidance from the partner agency.

5-11 Responsibilities such as the tour guide’s adverse conditions during the trip with partners are the responsibility of the partner agency.

5-12 Responsibilities arising from the breakdown of the vehicle rented by the agency or partner agency are the responsibility of the carrier company.

ARTICLE 6 MUTUAL RIGHTS AND OBLIGATIONS

6.1 The SELLER OR PROVIDER is obliged to notify the BUYER of any potential cancellation notifications in writing as soon as possible.

6.2 The provisions of this agreement concluded between the SELLER OR PROVIDER and the BUYER during the registration have been read by the BUYER, and he/she has requested and accepted the registration of other persons who will benefit from the same service under the same conditions as himself/herself. The BUYER/BYERS are jointly and severally responsible for the payment of the contract price. The BUYER confirms that he/she is also a party to this agreement on behalf of the participants indicated on the Voucher and represents and releases them from liability, knowing that he/she is obliged and responsible to inform them of the pre-information provided to him/her in accordance with the relevant legal regulations. The BUYER is responsible for all damages arising from the failure to fulfill the obligation to inform. In this context, the information given to the BUYER shall be deemed to have been provided to the participants.

6.3 If the BUYER does not accept the performance due to a defect in the service he/she has purchased, he/she is obliged to immediately notify the SELLER OR PROVIDER and the accommodation facility in writing, along with documents proving the defect. Otherwise, the BUYER is deemed to have accepted the performance and used the service. No refund will be made. The entire amount will be collected from him/her. It is the good faith obligation of the diligent BUYER to report any complaints during the execution of the service to the authorized personnel in writing.

6.4 Situations that did not exist or were not foreseen at the time the contract was signed and that develop beyond the control of the parties, making it impossible for one or both parties to perform their debts and responsibilities fully or partially, or to perform them on time, shall be considered as force majeure (Natural disasters, war, terrorism, riots, changing legal provisions, confiscation or strike, lockout, significant malfunction in production and communication facilities, etc.). If the force majeure prevents the realization of the contract, the affected party shall immediately notify the other party in writing of the situation. If the BUYER requests the termination of the contract due to force majeure, the SELLER OR PROVIDER shall make all efforts required to refund the amount. In the presence of force majeure, if the BUYER requests cancellation, the SELLER OR PROVIDER is obliged to refund the amount obtained from the person or organization from which he/she purchased or intermediated the service. He/She cannot be held responsible for the refund of the amount that has not been received.

6.5 The Seller or provider must fulfill its obligations within the committed time. If the seller or provider fails to fulfill this obligation, the consumer may terminate the contract. In the event of termination of the contract, the seller or provider must refund all amounts collected within fourteen days from the date the termination notice reached him/her, along with the legal interest determined under Article 1 of the Law on Legal Interest and Default Interest No. 3095 dated 4.12.1984, and return all valuable documents and similar papers that may have put the consumer under debt. In cases where the performance of the Seller/Provider is rendered impossible, it is obligatory for the seller or provider to notify the consumer within three days of the date on which he/she became aware of this situation, and to return all amounts collected within no more than fourteen days from the date of notification.

6.6 Before the contract is established, the consumer's explicit consent must be obtained for the request of any additional fee other than the basic fee agreed upon due to the obligations arising from the agreement.

6.7 Turkish citizens can enter the TRNC with a Turkish ID. It is recommended to enter with a Turkish ID since problems may arise later when entering Greece with a passport.

ARTICLE 7 CONFIDENTIALITY

The information specified in this agreement by the BUYER and the information provided to the SELLER OR PROVIDER for the purpose of making a payment shall not be shared with third parties by the SELLER OR PROVIDER. The SELLER OR PROVIDER may only disclose this information within the framework of legal/administrative requirement. Credit card information is not stored; it is only used to securely transmit to the relevant banks during the payment process, and after obtaining authorization, it is deleted from the system. Necessary illumination and information regarding the Law on the Protection of Personal Data have been provided to the BUYER, and necessary measures in accordance with the KVKK have been taken by the SELLER/PROVIDER in compliance with the legislation.

 ARTICLE 8 NOTIFICATION REGARDING PAYMENTS MADE BY BANK CARD

1.      a) The SELLER OR PROVIDER, a party to the contract, does not offer installment sales under any circumstances.

2.      b) Prices given to the BUYER are cash prices, and all installment payments are made without any additional charges applied by the SELLER OR PROVIDER on the credit cards obtained by the BUYER from various banks upon request. All transactions made with credit cards occur between the BUYER, the card owner, and the bank to which the card is associated, and the SELLER OR PROVIDER has no right to intervene in or assume responsibility for these transactions. In sales made in foreign currency, exchange differences may occur within the scope of agreements on cash payments and single installments or installment payments on related bank cards. All transactions regarding the sales made with credit cards occur between the BUYER, the card's owner, and the bank it is affiliated with, and TURPEREST has no right or responsibility to intervene in these transactions.

3.      c) The BUYER who purchases a service with a credit card is obliged to inform the bank regarding early payment, reduction of installments, etc., and to make payments at the branches designated by the bank.

4.      d) In the event that the BUYER cancels the service purchased on credit installment for any reason, the SELLER OR PROVIDER will refund the amount charged from the BUYER's credit card back to the BUYER's credit card. The responsibility of the SELLER OR PROVIDER is limited to this. After this, all transactions occur between the bank and the BUYER, and the SELLER OR PROVIDER has no right or responsibility to intervene in any such transactions. In refund transactions regarding installment payments, the bank rules apply, and in cases where refunds of installment payments are made back on the card as installments, the SELLER OR PROVIDER has no obligations or means to intervene. This situation must be resolved between the bank and the credit card owner.

5.      e) In purchases made with credit cards, the campaigns of the relevant bank on that date and the related terms for cancellation and refund shall apply.

6.      f) In cases of possible refund related to the relevant service, legal refund processes will be followed.

 

ARTICLE 9 COMPETENT COURT

All Turkey Republic Consumer Courts, Consumer arbitration committees, and other organizations authorized by law are competent to resolve all disputes arising from this agreement. The BUYER can submit complaints and objections to the Consumer Problems Arbitration Board or Consumer Court in the city where the BUYER has purchased the goods or services or where the BUYER's residence is located, within the monetary limits determined by the Ministry each year in December.

ARTICLE 10 CANCELLATION GUARANTEE PACKAGE NOTIFICATION

The Early Reservation Cancellation Guarantee Package is valid for reservations made in the Early Reservation products for a minimum of 3 nights and a maximum of 30 nights, excluding the transportation fee, for a total of 30,000 TL or less.

10.1- Consumers who purchase the Early Reservation Cancellation Guarantee Package can cancel their reservations unconditionally and without deductions up to 72 hours before the day of entry to the facility.

10.2- The Early Reservation Cancellation Guarantee Package does not cover the requests for changes in the date or names requested on the same product. In change requests, the existing product is canceled under the Early Reservation Cancellation Guarantee Package, and a new reservation will be processed for the new requested date, product, or names at the current conditions.

10.3 The Early Reservation Cancellation Guarantee Package is concluded for payment within a maximum of 3 days from the reservation date. It cannot be purchased for the 4th day and later.

10.4 The amounts charged for cancellation requests will not be refunded, and the sold Early Reservation Cancellation Guarantee Package cannot be canceled.

10.    5-All airline ticket reservations made together with hotel/tour accommodation (including prom and eco-class) are outside the scope of the Early Reservation Cancellation Guarantee Package, and the cancellation conditions and practices of the relevant airline company apply. The accommodation and/or other service amounts will be taken as the basis for charging the Early Reservation Cancellation Guarantee Package fee, excluding the transportation amount. In the application of the Early Reservation Cancellation Guarantee Package, the transportation fee will be excluded.

 ARTICLE 11 GENERAL PROVISIONS

11-1- Consumers participating in the tour have the right to carry and bring 2 pieces of luggage, not larger than 50 cm x 70 cm, for all trips; in flights, the right to carry 15 kg of luggage. All responsibility for the luggage and the items inside it rests with the owners.

11-2- Items with odors, liquids, flammable or explosive properties, or those causing discomfort, as well as sharp, piercing, and firearms, cannot be taken into transport vehicles and accommodation facilities without the travel agency's additional clear written permission. The existence of identification or licenses does not change this situation.

11-3- In the event of loss or damage to the luggage or belongings of the consumer, in cases where it results from the heavy fault of the travel agency staff, half (1/2) of the portion of the trip’s total cost allocated to transportation will be paid to the consumer as compensation for the lost or damaged luggage or belongings, regardless of their material and moral value or other qualities. The travel agency is responsible for all losses, damages, and disappearances of items that have been declared and delivered by the consumer, to the utmost value of the transportation fee of the trip.

11-4- Visa procedures and services are not included in the purchased service. The travel agency has no obligation to obtain a visa. It is the guest's responsibility to fulfill the visa and passport requirements of the relevant country to be traveled to.

11-5- The travel agency may notify possible cancellations of the tours individually to each consumer; alternatively, it can announce it generally through the publication in two high-circulation newspapers in Turkey.

11-6- The travel agency is responsible for changes that occur after the start of the trip included in the tour program purchased by the consumer. If there are significant changes against the consumer and it is clear that he/she has suffered damage, the travel agency may compensate the consumer with a refund or service equivalent according to the provisions of the TÜRSAB Kütahya Chart, as well as provide additional services not included in the price during the trip. The consumer's acceptance or use of additional or substitute services will eliminate the consumer's rights to refunds and compensation claims.

11-7- If the consumer leaves the tour or the accommodation service due to claiming defects, he/she must inform the authorized travel agency staff and the hotel in writing, with reasons. Otherwise, the consumer will not be considered to have left the tour and will be deemed to have availed and used the service.

11-8- If the consumer uses the purchased tour program until the end despite complaints, his/her rights for substitute services and refunds regarding the complaints will be nullified.

11-9- The provisions of this agreement, which is concluded at the time of registration between the travel agency and the consumer, have been read and accepted by the consumer, along with any individuals they declare will also participate in the same trip, under the same conditions.

11-10- Consumers who do not have their signatures on the contract but take part in the trip subject to the agreement are responsible for all legal liability towards the travel agency for any payments or refunds due to their other representatives named for registering with the travel agency. In the event that the travel agency is obliged to pay any amounts beyond what has been stipulated in this agreement due to lawsuits and enforcement against the consumer, the travel agency has the right to recourse against the consumers with signatory on the contract for excess amounts paid. Those participating in the trip, even if they have not signed, are deemed to have accepted the terms of this agreement, having learned them through catalogs and advertisements, and voluntarily participated in the trip under these terms.

11-11- The travel agency acts as an intermediary between the participating consumers and the hotels, the carrier companies, and other entities providing services related to the trip. Therefore, it is known that the travel agency will not be primarily liable for any delays, cancellations, or damages resulting from the failure of any transport program, the arrival of land, air, and sea vehicles, and any delays, accidents, or damages arising therefrom and any problems caused by weather conditions, road obstacles, strikes, terrorism, wartime conditions, or similar force majeure situations, notwithstanding the fact that third-person faults can arise through negligence.

11-12- For matters not stipulated in this contract, the provisions of the relevant laws, regulations, international treaties, and legal norms, including Law No. 1618, Law No. 4077, Law No. 4288, Law No. 2634, IATA, IHA, UFTAA conventions, Civil Aviation Law, Turkish Commercial Code, and Turkish International Treaty provisions, and the TÜRSAB Kütahya Chart applicable in Turkey will apply.

This voucher and package tour agreement has been prepared in two copies, duly signed by the authorized representatives of both parties along with all attachments, and has been read, checked, and acknowledged by both parties. The parties have mutually accepted all commitments and obligations, signing this acceptance together. The representative of the parties has expressly stated that he/she assumes full legal responsibility on behalf of the customers listed in this agreement.

COMPLAINTS REGARDING SERVICE DEFECTS: In case of provision of defective or faulty service, the TÜRSAB ARBITRATION BOARD is authorized.

The BUYER has the right to object or withdraw within 24 hours after the distance sales agreement has been declared to him/her in digital or physical format. If the distance sales agreement is not objected within 24 hours, its provisions shall be deemed accepted by the BUYER.
